KAIZEN GYM KIDS/TEENS WAIVER

In consideration for my child’s access to and use of the gym facilities at 35 Barry Ave, Mortdale NSW 22223 (Facilities) supplied by Kaizen Gym Pty. Ltd. (ACN 609 451 470) (Kaizen Gym) and my child’s participation in gym activities (Activities). (Required)

I, as the childs' parent/guardian, acknowledge and agree to be bound by this document on behalf of the Participant (Release, Indemnity and Waiver). Unless otherwise specified, the first-person pronouns below apply to both the Parent/Guardian as well as the Participant. (Required)

I acknowledge and will adhere to Kaizen Gym’s rules, as amended from time to time, and any directions given to me by Kaizen Gym’s staff members while using the Facilities.(Required)

I understand and acknowledge that my use of the Facilities and participation in the Activities involves physical activity and physical contact, and certain risks and dangers including but not limited to bodily injuries such as strains, fractures, musculoskeletal injuries, back injuries, muscle and connective tissue injuries, internal injuries, cardiovascular compromise, and complications in pregnancy, which may require medical treatment.(Required)

I fully accept and assume all liability for the risks, dangers, and hazards of, and the possibility of an accident, injury, or death from my use of the Facilities and participation in the Activities.(Required)

I warrant and represent that I possess the physical health and capacity to participate in the Activities. To the extent that I have any concerns or reservations about my ability to participate safely in any of the Activities, I will cease my participation in the Activities and seek medical advice. (Required)

I acknowledge that I am personally responsible for accounting for my own health and personal circumstances in agreeing to participate in the Activities. (Required)

In the event of an accident or injury, I provide my full consent for Kaizen Gym’s staff to perform necessary first aid and/or to call emergency services for further assistance. I acknowledge and accept that I will be responsible for any medical expenses incurred.(Required)

I waive any and all claims I have or may have in the future against Kaizen Gym, its officers, employees, agents and contractors in connection with my use of the Facilities and participation in the Activities, and I release, discharge and indemnify Kaizen Gym and its officers, employees, agents and contractors from any and all liability, claims, actions and demands of whatever nature, however, caused in connection with my use of the Facilities and/or Activities. (Required)

I agree that Kaizen Gym is in no way responsible for the safekeeping of my personal belongings while I attend the Facility.(Required)

I agree to indemnify Kaizen Gym for any damage which I may cause to the Facilities including but not limited to, any equipment, resulting from my participation at the Facilities. (Required)

I agree to hold harmless and indemnify Kaizen Gym from any and all liability for any damage to the property of, or personal injury to, any third party, resulting from my participation at the Facilities. This agreement is binding upon me, my successors, representatives, heirs, executors, assigns or transferees. (Required)

I consent to photographs, videos, and other multimedia representations to be taken of me during my participation in the Activities and for such representations to be published for advertising, promotional and marketing purposes. I hereby waive my rights to receipt of any compensation arising out of my appearance in such materials. I understand that if I do not wish for photographs, videos, and other multimedia representations of me to be used by Kaizen Gym, I must notify Kaizen Gym of this in wr(Required)

As the Parent/Guardian, I acknowledge and certify that I am currently over the age of eighteen (18) years old and have the full legal authority to execute this Release, Indemnity and Waiver on behalf of the Participant. (Required)

As Parent/Guardian, I have carefully read and fully understood the contents of this Release, Indemnity and Waiver and have ensured that the Participant fully understands the contents of this Release, Indemnity and Waiver.(Required)

I acknowledge this Release, Indemnity and Waiver is governed by the laws of New South Wales, Australia.(Required)
